These Terms of Service (“Terms”) govern your access to and use of CrowdfundInsider.com and any affiliated sites (collectively, the “Site”) operated by Crowded Media Group LLC (“CMG,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility The Site is intended for users who are at least 13 years old. We do not monitor or verify the age of readers, and our content is not directed at or age-restricted for any specific audience.
2. User Content and Submissions You are solely responsible for any content you post, submit, or make available on the Site, including but not limited to comments (via Disqus), press releases, tips, articles, editorials, statements, images, videos, and other materials (collectively, “User Content”).
By submitting content to the Site, you represent and warrant that:
- You own or have all necessary rights, licenses, and permissions to submit the content.
- For any images, photos, or graphics submitted, you have the full right to use, reproduce, and distribute them, and they do not infringe any third-party rights.
- The content (including any statements or content derived from submitted press releases or statements) does not violate these Terms, infringe third-party rights, or contain unlawful, harmful, defamatory, or offensive material.
By submitting content, you grant CMG a worldwide, royalty-free, non-exclusive, perpetual, irrevocable license to reproduce, modify, adapt, publish, display, distribute, and promote the content (or any derivatives) on the Site and in connection with our services. You agree that this license survives any later revocation of consent or request for removal. You retain ownership of your submitted content.
CMG reserves the right to keep, remove, or disable access to any submitted content at its sole discretion.
3. Third-Party Services and Advertising The Site uses third-party services, including Cloudflare, Google Analytics, Google Ads, Taboola, YouTube, Disqus, and other plugins. These services are governed by their own terms and privacy policies. We are not responsible for their practices or content. Advertisements and sponsored content are provided by third parties. We do not endorse them and are not liable for their accuracy or availability.
4. Intellectual Property All original content created by CMG (such as news articles, editorials, and other editorial material, excluding User Content) is owned by CMG or its licensors and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from CMG’s original content without prior written permission, except for limited personal, non-commercial use.
5. Prohibited Conduct You agree not to violate any applicable laws, infringe third-party rights, post spam or malware, scrape or data-mine the Site, impersonate others, or engage in any other harmful or unlawful activities.
6. Disclaimers and Limitation of Liability The Site is provided “as is” without any warranties of any kind. CMG disclaims all liability for any damages arising from your use of the Site, User Content, or third-party services. In no event shall CMG’s total liability to you exceed One Hundred U.S. Dollars ($100).
7. Indemnification You agree to indemnify and hold CMG, its officers, directors, employees, and agents harmless from and against any claims, losses, damages, liabilities, and expenses arising from your use of the Site or your submitted content.
8. Termination We may terminate or suspend your access to the Site at any time, with or without cause.
9. Changes to Terms We may update these Terms from time to time. The “Last Updated” date will indicate when changes were made. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
10. Governing Law These Terms are governed by the laws of the State of Ohio, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Ohio.
11. Miscellaneous These Terms constitute the entire agreement between you and CMG. If any provision is held invalid, the remainder shall continue in full force and effect.
